Spicoli, a male vice-principal at Ridgemont High School, was accused by two female students of sexual misconduct. The evidence, however, was not legally sufficient to prosecute the vice-principal and the charges were never proven. Because the vice-principal had job tenure, the school district agreed to write a glowing recommendation letter for the vice-principal in return for him agreeing to resign from the school. The letter stated that he was recommended "without hesitation."
Former vice-principal Spicoli now has started a new job at another high school, Glaswood High. While working there, he was convicted of sexually assaulting a female student. The assaulted student sued the school district where Glaswood High is located, and this school district in turn sued all parties involved at Ridgemont High. Is Ridgemont High liable?
