A lawyer for the defendant, a bank, e-mailed the plaintiff’s lawyer to say that the bank had completed an internal approval process, and that the settlement would be signed shortly. However, the agreement was never signed nor was the amount agreed upon sent to the plaintiff. The  the settlement had never been fully executed, and was therefore invalid. Is the settlement agreement enforceable? Why or why not?
