The only issue in regards to tort law cases that I have had any personal experience with is when one of my really good friend’s ex-wife tried to defame his character during their separation. To begin with my friend is a detective in a neighboring town in the area that we live. She had been having an affair with a prominent business man in the area. When my friend came home from work one day, she confronted him with the wants of a separation claiming that “she just needed sometime apart from the marriage to work on her inner-self” for the relationship to workout. When my friend found out through other friends what she was really up to, he confronted her with the truth and what he had found out from the mutual friends that they shared. Of course, then things got out of control on her end with denial of the affair and that he did not know what was really going on, that her and the business man were only friends and that was all. His mutual friends had pictures of her and the business man in some, needless to say, promiscuous situations.
My friend’s ex-wife was furious once the proof was discovered. She started rumors that he was abusive, and was stealing from the local police department’s storeroom to sell the items that he had taken. She even called the chief stating these same claims. By this time the divorce proceedings were starting through the legal separation process. The claims against my friend caused much tension at work, and also an investigation into the allegations from the ex-wife. My friend’s lawyer was trying to get him to also file for a defamation of character suit against the wife for the damages that it was causing his career. My friend did not decide to pursue the suit when the internal investigation conducted by the police department found him innocent. I think he should have pursued the lawsuit on principal purposes making sure everyone knew he was innocent.
I always have a hard time talking about this incident that did directly affect me in the case. I ended up going to court on his behalf and testify in regards to his character. I have known this man since first grade and he is absolutely one of the best and fairest people I have ever met in my life. I think he made his decision not to pursue the suit on the account of his then two-year old daughter.
