The concepts of justice and law are ones we can hope, will exist together. Unfortunately this is not always true. There are many times in society where the law does not achieve justice, where people are left without access to our legal system and where the crime does not fit the punishment or the punishment the crime. Justice is the idea of moral rightness based ethics. It involves concepts of equity and fairness as well as the process of law. There is disagreement about what rights are inalienable and if they apply to all human beings, to citizens or all living beings. John Rawls states that “Justice is the first virtue of social institutions, as truth is of systems of thought.” Justice is sometimes associated with the concept of fate. A sort of getting what you deserve. The idea of justice as fairness and equal treatment is a modern concept. The legal profession’s image of Lady Justice is interesting in that it depicts justice as equipped with three symbols, a sword symbolizing the court’s coercive power; a human scale weighting competing claims in each hand; and a blindfold indicating impartiality. Where do you think the legal system fails to provide justice? Be specific with an example… Was this a human failure, an institutional failure, a society wide failure?
