Based on Week Three Video Lecture, summarize each of the following: the Employee Free Choice Act, the Mandatory Secret Ballot Protection Act and the recent resolutions and rulings by the NLRB (see Week Three video).
- Employee Free Choice Act: Protects workers rights to join labor unions against unfair labor make it harder for employees to threatened workers if they decide to join. Since 2004, AFCA has been the number one legislative priority for labor leaders. It was originally passed by the House of Representative in 2007; supported by Democrats to boost union membership. First presented by Senator Biden and Senator Obama.
- Secret Ballot Protection Act: Introduced by Republicans requires secret ballots for union certifications. Voluntary recognition would be prohibited.
The National Labor Relations Board created by the Wagener Act. Members are appointed for a five year term by the President with the consent of the senate. It is an independent agency of the United States government and board members are in charge of the elections and investigating unfair labor practices. Recent rulings and resolutions passed are pro unions and two recent ones are expedited elections and contract employment. Expedited elections was issued by the NLRB to simplify representation case procedures and codify best practices to make them uniformed across regions. The board wants to shorten the election period from 40 days to as little to 14 days because research shows that the shorter the election period, the more likely unions will win. Contract Employment came about because of the case of the Teamsters v. Brown-Ferris which the NLRB ruled that a joint employer using contract labor are obliged to negotiate with the Teamster Union. Will impact business and franchises such as McDonalds will be affected when it comes to dealing with firing contract workers.

Discuss the pros and cons of each piece of pending legislation and the rulings that you discussed in Question #3. How would you vote on each of these? Give well-thought-out reasons.

It is very important in your role of HR director that you respond appropriately to a union organizing drive. You will read each of the four scenarios found on pages 225-226 in your textbook. Then you will do the following in response to each scenario based on what you have learned in Chapter 6 (Be sure to address each scenario separately:
a. Outline your various alternatives in responding to the union organizing drive for each scenario.
b. After outlining alternative for each, develop and support a specific recommended course of action for each of the four scenarios to present to upper management. Use what you learned in Chapter 6 as support for your recommendation.
