2. After the Tarkanian decision, public universities can, by acting collectively through the NCAA, regulate areas that they might not be able to regulate on their own. For example, the NCAA can conduct drug testing of student-athletes without having to face scrutiny under the Fourth Amendment prohibition of unreasonable searches. But if a public university implemented its own drug testing program, the Fourth Amendment would apply. Can you make a rational argument for why this is just? How about for why it is unjust?
