In the near future, robots with artificial intelligence become much more prevalent in American society; these robots interact with humans on a daily basis, perform basic customer service functions, and walk among us. Congress sees the need to create an administrative agency to oversee the Robot Issue. You are a junior congressman (or woman) and it is incumbent on you to draft the legislation which creates the appropriate agency to regulate robots.

A. Explain, in basic terms, the process that will need to occur to in order for the appropriate agency to be created. Be sure to use all appropriate terminology when describing the legislation and to detail what, in general, needs to be contained in the legislation. Also be sure to name your legislation and the agency created by it (bonus points for creativity).

B. In my example, the Robotic Regulatory and Directing Division Act creates the Robotic Regulatory and Directing Division, R2-D2 for short (yes I know its clever; no you cannot use my example, come up with your own). R2-D2 wants to pass a new rule which would require all robots to be 3 laws compliant. (If you do not know what that means, GOOGLE IT). Explain in general what steps R2-D2 must take to properly promulgate this new rule under standard notice-and-comment rulemaking procedures.

C. Years after R2-D2 is created, R2-D2 issues an interpretive ruling as to a specific provision in the Robotic Regulatory and Directing Division Act. This interpretive ruling is challenged at the administrative level by People for the Ethical Treatment of Every Robot (PETER), a political activist group supporting and lobbying for robot rights. Upon review, R2-D2 asks the court to defer to its interpretation of the Robotic Regulatory and Directing Division Act. What landmark U.S. Supreme Court Case will R2-D2 cite to when asking for this deference? What factors (steps in analysis) must the court consider in when deciding whether or not to defer to the agency interpretation?
