a) Firefox Hell works as a firefighter for the City of Windhoek. Along with dozens of his fellow fire fighters, they petition the management of the City for a 12% salary increment. Due to the covid virus pandemic and its associated economic challenges, the city rebuffs their petition. They decide to go on an indefinite strike until such a time their demand is met. Alarmed, the citys management applied to the High Court for an urgent interdict. The city argued that such a strike will be illegal and contrary to the provisions of the Labour Act. Based on the provisions of the Labour Act and other labour related laws, do you think the citys actions are justified in this regard? (8 Mark)

b) After reaching a deadlock between the Farmers Union of Exploited Farmworkers and the Tobacco Producing Company of Namibia, farm workers decide to go on a legally sanctioned strike. Within three days after the strike, the tobacco company lost close to N$ 50 million. To avoid further loses, the company decides to hire about 25 casual workers to do the work of striking employees. Advise as to whether the companys actions are in line with the Labour Act or not. (4 Mark)
