Question:
A foreign national initially came to Canada in 2010 on a visitor visa to visit their biological child who was previously sponsored to Canada by their Canadian parent. The foreign national was in a relationship with the child's biological parent in their country of nationality and the child was born out-of-wedlock there.
Between 2012-2014, the client continued to travel back and forth between their home country and Canada to visit their child. This relationship was abusive and their partner usually physically and emotionally tormented them. Unfortunately, the client cannot escape their partner in their country of nationality because the partner has many connections to known criminal organizations and corrupt police officials. In 2016, the client travelled to Canada on a visitor visa and filed a refugee claim at an inland IRCC office.
The RPD Member denied the refugee claim due to insufficient supporting evidence. The client sought advice from an RCIC.
What should the RCIC advise the client to do?
