Question:
Advise him on how to proceed with a complaint against the Home Office.
Sandro is a Romanian national who has been living in Liverpool since 2011. In the run-up to the United Kingdom's exit from the European Union, he applies to the Home Office for 'settled status' to remain in the UK in accordance with the UK Government's EU Settlement Scheme. He completes the necessary online application in July 2020. In September 2020, the Home Office writes to him to confirm that his application for settled status has been rejected. His application was refused as ineligible on the basis that 'Romania is not in the European
Union/European Economic Area.' Sandro successfully appeals that decision to the First-Tier Tribunal (Immigration and Asylum). However, 6 months later, the Home Office has still not approved his settled status in accordance with the Tribunal's decision. When he calls the Home Office, he is told that it has 'no record of the Tribunal decision' and advises him to submit a new application. Sandro is frustrated with the Home Office, but also very anxious about the
implications of the Home Office's delay on his continued right to reside and work in the UK post-Brexit. He also learns from conversations with friends from Romania, Bulgaria and Croatia that they are also experiencing similar problems.
Sandro turns to you, an official at the Office of the Parliamentary and Health Service Ombudsman (PHSO), for help.
