Allan is a passenger bus driver. While on the expressway sending passengers to their destination, he receives a text message on his mobile phone (an SMS). He takes the phone out of his pocket and reads the message quickly while still driving the bus at 80 kilometres per hour (kph). As he starts to send a reply to the SMS using one hand, he takes his eyes off the road. He does not notice that the car in front of him has slowed down. He looks up but it is too late to stop. The bus crashes into the car in front. The car's driver is thrown forward and hits her head on the steering wheel. As the result of having an unusually thin skull, the driver's skull breaks causing instant death. The driver's husband now wishes to bring civil action against Allan.
