Alpha Construction Sdn Bhd (the Company') is a property developer. On 1st July 2019, the Company entered into a contract with Datuk Ali whereby the Company agreed to purchase an office building owned by Datuk Ali for a total purchase price of RM 15 million. The transfer of ownership, handover of documents and keys will take place on 11th July 2019. However, on 10th July 2019, a fire occurred and destroyed the building. On 11th July, Datuk Ali was not able to hand over the documents and keys. The Company Management were furious over what happened and threatened to bring an action for breach of contract. However, Datuk Ali claimed that it was not his fault.
