As you read through the case and see an issue, you must correctly state the issue in one sentence in the form of a question just like the cases we do in class. After you state the issue, you must give the legal principle that answers the issue. Example:Issue: Were the judges jury instructions incorrect because they eliminated the requirement of intent for a criminal conviction. Legal Principle: Criminal liability only occurs with an Act and Intent. Then proceed to the next issue and do the same thing by stating the issue and the legal principle that answers the issue. Your answers must be in this format of Issue followed by Legal Principle or they will be incorrect. The exam requires very little writing but very much thinking and analysis. There will be multiple issues in each case.
Jim and Bob get laid off from their jobs and can't afford to pay the rent. Bob says to Jim, "Take my gun and go down to the corner gas station and rob it so we can pay the rent". Jim responds, "I'm not going alone, you need to come along and help". They agree to rob the gas station so Bob gets his gun and they start walking to the gas station. While walking down the sidewalk, Bob and Jim begin arguing about who will use the gun and how much money they need. A person on the sidewalk calls the police to complain about the loud arguing and the police arrive at the scene. The police hear the loud argument and arrest Bob and Jim and give them citations for disorderly conduct under the following criminal statute. "Anyone who intentionally engages in loud and boisterous behavior that disturbs other persons in a public place shall be guilty of disorderly conduct and may be punished by a fine of up to $250.00 and imprisoned up to 10 days".
