Scenario:

You own a garden center/landscaping business called PRETTY YARD. PRETTY YARD handles home gardens and landscaping for individual homeowners. This is your busy season, and your employees are fully utilized/booked on jobs. Because you want to serve all customers who call in, you decide to SUBCONTRACT homeowners in a local retirement community to EZ YARD, another independent landscaping company.

Here is the scope of the project you subcontract to EZYARD:

1. PRETTY YARD will work with the customer to draw up a design and enter it into the PRETTY YARD proprietary software system. EZ YARD will deliver to the exact specifications in the design located in PRETTY YARD's software.

2. EZ YARD will utilize all of the mulch, plants, dirt, trees, etc. that PRETTY YARD has in stock. EZ YARD may not purchase or use any items from other sources.

3. EZ YARD will utilize their own (EZ YARD) garden tools to perform the contracted work. It is expected that any tools beyond normal yard maintenance (shovels, rakes, claws, post hole diggers, wire cutters, pruning shears, blowers, mowers, etc.) will be contracted by and provided by EZYARD. Examples of machinery beyond typical tools incude backhoes, cranes, large augers, machines that are unique or need to have a driver for operation.

4. EZ YARD employees must have taken and completed a landscaping safety course, also provided within the PRETTY YARD IT system. This must be done prior to beginning any work.

5. EZ YARD will provide warranty service for any damaged plantings or items deemed unacceptable by the homeowner for up to 90 days after final acceptance. Plants will be replaced with the written approval of PRETTY YARD after documented inspection by PRETTY YARD management.

6. Final acceptance will be done by an in-person inspection consisting of the homeowner, PRETTY YARD management, and EZ YARD management. It will be documented on a checklist, signed by the 3 parties, and scanned into the PRETTY YARD software system.
