Question:
At a company Christmas party Barney scares John and Holly by putting on a ski mask and telling them to give up their money. John, not realizing it was a prank hits Barney and knocks him out.
Seeing that the assailant is knocked out, John removes the ski-mask and realizes it is a now unconscious Barney who was probably just playing a prank. This makes John mad because he and Holly were really frightened.
Angry with the prank, John grabs the mask from Barney's now unconscious head. John and Holly then carry unconscious Barney and locks him in the trunk of their car.As they drive home with Barney, John throws Barney's ski mask out the window of the car. John watches as the mask floats away and over the rail of the bridge into the river below.
Barney lives near Holly and John, so when Holly parks near her house she decides to just leave Barney in the trunk and let him walk home. Before John and Holly walk to their house she opens the trunk just a little so that Barney can get out when he wakes up and so that he will have enough air. Barney wakes up a few minutes after John and Holly have left and is momentarily scared when he thinks that he is trapped in the trunk, but then realizes that it is not locked. He climbs out and walks to his house.
QUESTION: What Intentional Tort claim(s) might Barney have against John and/or Holly? (Explain who he would have the claim against and how the elements of the tort are satisfied with the facts given.)
