Brents Thread:
There are multiple competing rights in this particular scenario. Ultimately, the parents of the child could be held liable because they allowed a 6-year-old to play in the roadway. The child, unfortunately, is breaking the law since many states don't allow pedestrians to be in the roadway. However, the child is not culpable for their actions due to their age. The police officers are responding to what is statistically the most dangerous type of pursuit there is. The pursuit of time in trying to aid another officer. As a pursuit driving instructor for the past 12 years, this is always brought up in all of my classes. In everything that I have read, I can only find three ways to deal with competing rights and that is to defuse the situation, decide what is more right and seek advice.
In this particular scenario, what is more right would be to veer to the right and go down the embankment. As a police officer, we are supposed to protect those who cannot protect themselves and a small child is unable to do that. I would take my chances with knowing that a cage in my police car functions like a roll cage and hope that my partner and I were both wearing our seatbelts and may, potentially, survive the crash. Either way, I would take the drop as I wouldn't be able to live with myself for killing a child.
John's Thread: Competing Rights:
In the given scenario, the competing rights are the duty to protect your fellow officers (both the officer calling for help and your partner in the car) and the duty to protect the life of innocent citizens, in this case, the child.
Methods to Cope With Competing Rights
The three methods of dealing with competing rights are to defuse the conflict, decide what is more right, and seek advice. In this instance, protecting the life of the child takes priority. Striking the child may save my life and my partner's, but we will have killed an innocent child and also would not make it to the original call for help.
My Choice and Actions.
In this case, I would take the car off the road down the drop-off. Police officers have a duty to protect the innocent, even if that means sacrificing their lives. Being a Christian and knowing where my eternity will be spent, death is not a fear of mine. This would likely have been discussed between the partners previously, not this exact scenario but the overall decision to save the citizen rather than ourselves.
