Victoria is a new program manager in a state's Environmental Protection Office. One of the programs she manages is the state's Environmental Stewardship of Agricultural Pesticides program or ESAP. ESAP is responsible for analyzing whether current pesticide regulations for agricultural pesticides are effective. That is, ESAP determines whether the state's regulations on agricultural pesticides effectively protect human health and the environment while also remaining flexible enough to ensure the economic livelihood of farmers. State policymakers established the ESAP program in 1978 after a number of pesticide poisonings killed 34 citizens.

In her first month on the job, Victoria examines the ESAP program and discovers a number of surprises that leave her perplexed. First, she learns that the ESAP program has no power to regulate agricultural pesticides. The actual state regulations for agricultural pesticides are crafted and implemented by the state's Department of Agriculture. Second, she discerns that the Department of Agriculture does not communicate or coordinate their agriculture regulatory efforts with the ESAP program. The ESAP program literally finds out about new pesticide regulations when they are officially released to the public and codified into administrative law. Third, Victoria discovers that the ESAP program has issued no reports on agricultural pesticide regulations since 1989. And lastly, she discovers that the state's pesticide regulations (as designed and implemented by the Department of Agriculture) are severely outdated and may even be in non-compliance with federal regulations on agricultural pesticides.
