The contract with Noble states that "the Contractor shall be paid for all materials and equipment consumed in performing the contract." Noble presents an invoice for two hammers and three screwdrivers used in the construction of the Jones' home. However, the Jones' refuse to pay, stating that the tools are overpriced and could have been purchased on sale for half the invoice price. Noble sues them for the amount of the invoice. The Jones' also argue that the colour of the tiles is not what they ordered. They are unhappy with the general workmanship and want a refund.
