Geoff is a yearold client who requires a wheelchair to mobilise independently. To enable him the opportunity to still live independently he has a care worker to assist during outings, and toileting when on outings as Geoff is unable to lift himself without the use specialised equipment installed at home. He is regularly supported with a communitybased support service to assist in maintaining his independence David is a care worker with a local support service who supports Geoff with his personal hygiene and most of his daily living activities.
Part of Geoff's support plan includes going to the local footy once a fortnight. However, this weekend the grand final is being held at the main football ground in town.
When Geoff and David get to the football ground, David sees a few of his mates sitting up in the stan They wave at David and call him to come up and sit with them. David asks Geoff if he would mind stayin where he was whilst David went and sat with his friends. Geoff is unable to move to the same area there is no wheelchair access. Geoff agrees for David to go sit with his friends.
Whilst both men agree that the footy game was enjoyable, later that night Geoff became angry wi David for leaving him on his own to watch the game. He decides that he is going to sue David for brea of duty of care.
