For the purpose of safety and protection, Roche Pharmaceutical, Inc., required their operations employees, including Yvette Choi, to wear steel-toed boots. One of Chois boots caused a sore on one of Chois legs. The skin over the sore broke, and within a week, Choi was hospitalized with a methicillin-resistant staphylococcus aureus (MRSA) infection. She filed a workers compensation claim. Roche Pharmaceutical, Inc. argued the MRSA bacteria that caused the infection had been on Chois skin before she came to work.
