Scenario Bill and his buddy Ted were standing outside the Circle K in downtown Albuquerque, New Mexico, drinking Big Gulps and eating Red Hots when four police cars suddenly pulled into the parking lot. A few police officers jumped out of the squad cars and entered the Circle K where they began questioning someone inside. Some of the other officers got out of their cars, but remained in the parking lot. The officers inside the Circle K proceeded to make an arrest. At the same time, one of the officers in the parking lot who was standing near Bill and Ted turned to them and said, "Can I ask you guys a question?" They both nodded their heads. Then the officer asked, "Are you guys carrying anything illegal?" Ted shook his head, but Bill became noticeably nervous and wide-eyed. The officer began to approach Bill along with a few other officers. The officer then repeated the question as his fellow officers closed in on Bill. Ted scooted away. Bill then mumbled something about his back pocket. The officer, who was now right in front of Bill with three other officers next to him, asked Bill to turn around and put his hands on the wall. Bill did and the officer felt of his back pocket and then removed a small bag of cocaine. Bill was placed under arrest. Bill is being tried in the Federal District Court of New Mexico for possession of a controlled substance. Bill argues that the bag of cocaine should be suppressed along with his subsequent confession because it was seized in violation of his Federal Fourth Amendment rights. He argues that the officer questioned him and seized the bag of cocaine without probable cause or reasonable suspicion. He was just drinking a Big Gulp and eating Red Hots, which is what one normally does in a Circle K parking lot.
