The problem of jail overcrowding due to pretrial detention has reached crisis levels across the United States. Despite the reforms intended by the Bail Reform Act of 1984, data consistently shows that a substantial majority of jail inmates have not been convicted of any crime. The Vera Institute of Justice has documented that approximately two-thirds of all jail inmates are pretrial detainees (Sawyer & Wagner, 2023). This represents a significant shift from the historical purpose of jails, which were primarily designed as short-term holding facilities. As Dobbie and Yang (2021) noted, this pattern emerged partially from the Bail Reform Act's preventive detention provisions, which expanded the judges authority to detain defendants that are deemed dangerous.
