In this case Nancy is filing a legal charge due to suspected sex discrimination when she was turned a position that she thought she was able to perform. After the legal complaint is filed the EEOC will proceed in the following way to investigate, process, and finally dictate a verdict. First the EEOC will send an official notification to inform the company that a legal charge was filed against them and that an investigation will take place to clarify the situation, just because charge was file it does not mean that the company is automatically found guilty of this. During the investigation, the EEOC will give the opportunity to both parties to come to mediation and try to negotiate if it is possible. In this case Nancy and the company that is been charged would have to provide evidence to the investigator to show proof that there is evidence of discrimination or not. EEOC will give the opportunity to both parties to show any valid evidence, in case that the parties involved cannot encounter a proper negotiation and the EEOC can provide a final decision. Therefore, after the decision from EEOC is informed in the case of finding the company acted with discrimination, EEOC will rule the imputation of the indicated legal charges.
