D Developer is developing a large tract of land with five new homes. D bought the land prior to commencing the development. D designed and created water lines, telephone lines, electricity access and cable TV lines throughout the property for all five homes. The other sides of tracts 4 and 5 are surrounded by water. After only being able to sell three homes, D decided to cut her losses and put undeveloped tracks 4 and 5 on the market. B Buyer bought tracts 4 and 5 and built two homes. The deed was silent as to the easements. B assumed that he would have total access to the electric, water, cable and telephone lines. But after selling B the property, D denied B use of these lines. B instituted a lawsuit claiming D had an easement to the property.
