Question:
Discrimination? Review the resources required for this module, in particular the case Mercado Rivera v. Catholic University of P.R.: 143 D.P.R. 610 (1997). Available in the LexJuris database at the Virtual Library. Links to an external site. Write an essay in which you evaluate the hypothetical situations provided and argue whether or not some type of discrimination occurs. Cite the laws that apply to each situation and support your arguments with related academic material. Evaluate each situation separately.
Situation I: Ms. Daisy Franco began teaching for the Catholic University on August 1, 1989, signing an annual service contract each year. Said contract required observing a conduct in accordance with the values and ethical norms of the Catholic Church. Professor Franco performed her duties efficiently for eleven years. However, on November 24, 2000, Franco was informed that her contract would not be renewed. The reason for her dismissal was that the university authorities determined that the professor was in a canonically irregular situation for having married a person, previously married by the Catholic Church, whose first marriage had not been declared null.
Was there any type of discrimination against Professor Franco by the Catholic University?
Situation II: A security guard company makes it a job requirement that a person must be at least 5'8" tall. Is this measure discriminatory?
Situation III: A dark-skinned person is fired from his job for having questioned a directive from his supervisor. Previously, three light-skinned individuals had challenged the same directive to their supervisor and the action taken by the company had been to reprimand them. Can the employer's action be considered discriminatory?
For each situation: 1. offer your position on the situation or controversy; 2. evaluate the laws that apply; and 3. justify your position with ideas, theories or models that are relevant to the topic.
