Consider the following scenario: Attorney Brown has a client facing charges of capital murder in a case where two young girls have been missing for six months and are presumed dead. The client has agreed to plead guilty and get a life sentence. As part of the plea deal, he has to tell the court what happened to the girls. He confesses to murdering them, but refuses to disclose where their bodies are. He says, in open court, that he's told his lawyer where they are but didn't give Brown permission to disclose.
