For this question, consider what you read in Chapter about alternative methods of
dispute resolution ADRs
Assume you need to install software on your computer that is absolutely required for
a school or work project. When you go to the website to download the software, a
window pops up with terms and conditions several pages long in a small font. When
you scroll to the bottom of all the terms and conditions, there is a box for you to click
to acknowledge reading everything and agreeing to the terms. You cannot install the
software without first clicking the box to accept the terms. Normally, you just click
boxes on web sites like these without reading anything, but this time, you decide to
check out one section of the terms. This is what you read:
Binding Arbitration If You Live in the United States. We hope we never
have a dispute, but if we do you and we agree to try for days, upon
receipt of a Notice of Dispute, to resolve it informally. If we can't, you and
we agree to binding individual arbitration before the American
Arbitration Association AAA under the Federal Arbitration Act
FAA and not to sue in court in front of a judge or jury. Instead, a
neutral arbitrator will decide and the arbitrator's decision will be final.
Identify the methods of ADR which you are required to use to resolve any dispute you have with the software company.
Discuss the pros and cons if any of using these ADR methods, both for you and the software company. Identify the page numbers from your textbook where you found the answer to this question.
Explain why the software company, and thousands of other companies, require customers to agree to these types of terms before doing business with them.
Discuss whether these terms are fair for consumers, like you, considering that most people will never read the terms and click "accept" without giving them any thought.
