For this question, consider what you read in Chapter $5$ about alternative methods of

dispute resolution $($ADRs$).$

Assume you need to install software on your computer that is absolutely required for

a school or work project. When you go to the website to download the software, a

window pops up with terms and conditions several pages long in a small font. When

you scroll to the bottom of all the terms and conditions, there is a box for you to click

to acknowledge reading everything and agreeing to the terms. You cannot install the

software without first clicking the box to accept the terms. Normally, you just click

boxes on web sites like these without reading anything, but this time, you decide to

check out one section of the terms. This is what you read:

Binding Arbitration If You Live in the United States. We hope we never

have a dispute, but if we do$,$ you and we agree to try for $60$ days, upon

receipt of a Notice of Dispute, to resolve it informally. If we can't, you and

we agree to binding individual arbitration before the American

Arbitration Association $("$AAA$")$ under the Federal Arbitration Act

$("$FAA$"),$ and not to sue in court in front of a judge or jury. Instead, a

neutral arbitrator will decide and the arbitrator's decision will be final.
