However, cases and other statute suggest that it is not always necessary. Discuss. (25 marks) Q2. Raymond, who is in the business of selling exotic birds formed a contract with Ali whereby Ali paid RM8,000 for a particular rare species of bird to Raymond on 1s February 2021. Raymond promised that he can deliver the bird by the end of the month. On 7th of February 2021, the Malaysian government made amendment to the existing law and made that particular species that Ali was looking for into the protected category, prohibiting the sale of that type of birds. Raymond now refuses to deliver on the contract he formed with Ali. According to Ali, the contract he formed with Raymond was before the changes to the law and therefore Raymond must deliver on the promise.
