The homeowner was within his rights to look for and confront the suspect because he homeowner is just trying to get his belongings back and because the police are often occupied with other criminals, they might not be looking for the suspect. If he can look for the suspect, he can turn the suspect into the police. However, when he chased that suspect, he did not have any rights to fire at the suspect. The homeowner would get charged because the suspect was not putting the homeowner at a life threatening risk. The suspect was actually just running away, in which since the homeowner shot and killed him which has now put the homeowner as a criminal. The homeowner will not be charged of a violent crime because he murdered the suspect. Some defenses that the homeowner might raise against the charge are justifiable use of force and necessity. The homeowner might feel as though they were unsafe and in which has to use force to ensure that they are safe. But as I had stated before, since the suspect was running away when the homeowner shot him, the defense of justifiable use for force would most likely be dismissed since they were at no harm. The other defense the homeowner could use is that it was a necessity to shoot at the suspect. They could say that they felt as if it was necessary to shoot at the suspect to injure them to ensure that they would not be burglarizing any other properties and so that they can get the suspected charged for burglarization."
