I am having a hard time breaking this case apart into an IRAC. The case is People v. Ross, 19 Cal.App. 469 (1912). The defendant was found guilty of a felony assault for pointing a pistol at a city recorder who was trespassing on his property. It does not clearly state what the argument by the state is nor what the defense was for the defendant. I also do not understand the entire issue other than did the city recorded have a right to be on the property or was he trespassing. The judgment was reversed so I am assuming the holding is that the recorded was trespassing and did not have a right to be there on the defendants land, but I am not sure of the reasoning.
