Question: I am representing my client in a mock case and my client has had two DUIs in one month with a BAC reading of .30

I am representing my client in a mock case and my client has had two DUIs in one month with a BAC reading of .30 and .32  My opponent may go for my client to do jail time or fine but I want to present evidence such as he has been wearing a monitor so he hasn't drank as well as attended AA meetings and atttended therapy as well.  Is this enough to get him to let's say just get him fines and maybe ask to get a device set up in his car .. do you think this is a good idea.  Just trying to come up with a good defense.
