The arbitration agreement provides that the arbitrators are authorized to award up to $250,000 in damages in any particular.
However, the arbitrator of one of the parties concluded there were gross violations of the law worth $400,000 in damages.
The arbitration award states: $400,000 in damages.
Is increasing the remedy amount from $250,000(which is the limit) to $400,000 grounds for dismissing the award? Is it considered an act where the arbitrators exceeded their power, or so imperfectly executed the award?
