In March 2022, Fabricio, a resident of Brisbane, had a car accident in Melbourne with Goosfelt, who resides in Victoria. Fabricio was on vacation in Victoria when the accident occurred, and Goosfelt accepted responsibility for the incident. In June 2022, Fabricio initiated legal action by bringing a claim in the District Court of Queensland, seeking compensation for the neck injuries he allegedly suffered because of the accident. These injuries have prevented Fabricio from working his normal hours, resulting in a loss of income and potential career advancement opportunities. The applicable substantive provisions for the accident are governed by Victorian law. According to the Victorian Transport Accident Act of 1986, certain requirements must be met for a claim to be successful. One such requirement is that the claimant must have a police report of the accident and must have provided an insurer with a statement of claims before commencing legal proceedings against them. However, Fabricio has not fulfilled these obligations directly or through his solicitor, who initiated the District Court action against Goosfelt. 

 

Given these circumstances, Fabricio seeks assistance in determining whether (1) the District Court of Queensland has the jurisdiction to hear his claim, and (2) if he needs to comply with the requirements of the Victorian Transport Accident Act of 1986 for his claim to have a chance of being successful.
