Introduction:

You will identify, analyze & mitigate potential liability and risk at a sporting event based on the Sports Track Case Study. You will review the potential risk factors at the sports teams fan fest from a legal perspective. Risk management is a factor in multiple areas of the sports business industry, and understanding how to mitigate risk is a vital tool in both areas.

Objectives:

• Identify potential variables for liability at sporting events.
• Analyze duty of care requirements to various individuals & groups at sporting events.
• Evaluate steps to mitigate risk and liability at sporting events.

This assignment utilizes the Case Study, located in the list of activities on FSO. These scenarios and the parties involved in the negotiations are all entities involved in the creation of an NFL expansion team in Orlando.

For this assignment, you will focus on the two fan-fest events outlined in the last two paragraphs of the Case Study. These events will be located at the current Camping World Stadium.

Instructions:

Answer the following questions, using the references and content for risk management, negligence, torts, and liability. Your answers should be written in paragraph format, at least 2 to 3 sentences per question or point to address, detailed and specific. You dont have to sound like a lawyer, but you should be coherent and thorough to demonstrate your understanding of the elements of the law and applicability to the sports business industry.

3. During the preparation for, and execution of, these events, in general, what are the potential liability concerns for each of the following groups? In your analysis, you should consider whether each particular group could be liable for potential actions (or inaction) or the victim/recipient of an action for which someone else is liable, or for accidents. Consider the elements of intentional torts and negligence.

5. Does the risk management analysis change regarding fans for the invitation-only event versus the event open to the general public?

6. Who/what else might also be legally responsible for accidents occurring during the event?

7. What are some ways to offset or reduce liability at the event?

8. Does assumption of risk apply to liability issues in this situation? Would assumption of risk factors affect the above groups of people differently? Should they know of, or be warned of, potential risks from the event?
