Rags to Riches is is a local consulting group that helps young people learn to save money to achieve their goals in life. The consulting group is run by Amber, a recent college graduate and self-made businessperson. She hires her neighbor, Sam, to work at her new company. Sam is a forty-eight-year-old man who has experience in the industry. Amber thinks that he might be able to help her run the business and get clients. Sam's title is Director of Business Development. Amber decides to make one of Sam's responsibilities to run the social media carimpaigns for the consulting group.
Amber meets with Sam on his first day of work and tells him her plans for the handling of the social media. Sam tells Amber that he doesn't understand social media and he can't do it. Sam reassures Amber that they will be able to reach out to potential clients through tv and print abs. Amber is furious and tells Sam, "I should have hired someone younger than you! You are ancient!".
Sam is devasted. He tells Amber that he will try and learn about social media and do the job she wants him to do. Sam enrolls in an on-line course to learn more about it. Sam posted a Tik Tok on the consulting group's account and is super excited to see Amber's reaction. Amber sees it and is completely embarrassed! Sam did not do a good job at all. The Tik Tok post is undeniably bad and was full of offensive and racist content. In fact, many people who saw it called into the company to complain. Rags to Riches is now the subject of a complaint from the state department of discrimination.
Amber calls Sam into her office Monday morning and fires him. Does Sam have a claim against Amber or Rags to Riches?
