John is a small-scale woodwork contractor. He entered into a contract with Cape Fundations, a local non-governmental organization to provide wooden kennels to house rescued animals. At the time if entering the contract, due to the international animal rights requirements, John was supposed to possess a Class One woodwork qualification. John claimed he had but he did not. Timmy, is an employee at Cape Foundations and is a friend to John and had provide John with some guide on roughly the price he can charge to win the tender. Cape Foundations also told John that the cash for the work was available and at least a 50% deposit will be advanced before works commence. This however did not happen as the sponsor suddenly faced financial problems and could only fund 30% of the initial amount. Six months has lapsed and no work has commenced. John wants 50% deposit. The client wants 30% of the work done. Both parties want to seek the services of a mediator and you happen to be one.
