Julian enters a contract to buy a racehorse from Mustafa so that he can enter the racehorse in a race in two weeks' time. The horse, named Spirit looks strong and healthy and Mustafa tells Julian that Spirit is very fast and has won two out of his last three races. The contract states that the horse is healthy and ready to race immediately. Julian pays $10,000 for the horse and as he is leaving, he asks Mustafa if Spirit is a gentle horse. Mustafa tells Julian that Spirit is very gentle. However, the next day Julian discovers that Spirit is in fact a very vicious and bad-tempered horse. He calls his local vet who examines Spirit and tells Julian that Spirit is sick and will not be able to race for at least two months. Julian would like to sue Mustafa for breach of contract because Spirit is bad tempered and because Spirit is unwell. He wants to sue Mustafa for the vet's medical bill of $1,000 and the $4,000 prize money and disappointment/distress from not being able to enter spirit in the upcoming race.
