Gentlemen
I understand from Mr Emerson that the insurance company feels that the chgs for my services
on June 30, xxxx is excessive.
Mr Emerson was seen on a early Sunday morning with a stab wound in his chest which had
penetrated his lung producing an air leak into his chest wall. In addition he had a laceration of
his lung.
After consultation and review of his xrays his laceration was repaired. He was observed in the
hospital for two days to be sure that he did not have continuing hemorrhage or collapse of his
lung.
I feel that the bill given to Mer. Emerson is a fair one. We received on July 31,20xx a Tellemer
Insurance Company check for $80 anjd I feel that your payment of $80 is unreasonable. It is
doubtful that one could get a plumber to come out early Sunday morning to fix a leaky pipe for
$80 and Mr. Emersons situation in my opinion was much more serious that would be
encountered by a plumber.
We will bill Mr. Emersen for the remainder of the $400 balance on his account but I want you to
know that we feel that your payment is insufficient. If he feels that the bill is excessive we will
be glad to submit to arbitration through the County Medical Society Fee Committee. If this fails
I suggest we week help through the New Mexico Insurance Commission.
Sincerely yours William A Berry MD
