Your supervising partner asks you to draft a memorandum of advice. This advice is ultimately for a wealthy but uneducated client. Your draft will go to the senior partner of your firm for review before going to the client.

The advice topic is:

'The advantages and disadvantages of resolving disputes through mediation, arbitration, and litigation'.

NOTE:

Students must:

• draft a concise research plan; include this in the introductory commentary

• research and identify the relevant law and policy issues

• apply the principles outlined in the workshops as regards preparing a memorandum of advice

• make clear which of the models or frameworks students have adopted and give reasons

• take care with layout. If appropriate, use tables and any other aids that make the memorandum easy for a layperson to understand. If students use tables, they must add some commentary in narrative form

• draft the memorandum in clear, concise, and correct plain language
