On September $8,2009,$ John Coomer went to a Kansas City Royals baseball game. As a promotional event the Royals mascot launched $20$ to $30$ hot dogs at the fans, either by throwing them or by firing an air gun. The hot dogs shot out of the air gun were wrapped in bubble wrap and the ones thrown by hand typically were wrapped in foil. Just as the mascot tossed a foil$-$wrapped hot dog from behind his back in Coomer$$s direction, Coomer looked over at the scoreboard and the hot dog hit him in the eye. The impact caused a detached retina and other eye problems, leading to two surgeries. Coomer brought a personal injury lawsuit against the Kansas City Royals.
