One Saturday night, Omar and Amina are hanging out in their rental apartment when they hear a scurrying in the upstairs room. Omar has an extreme fear of animals so when he sees the apartment complex's security guard, Noah, walking past his living room window, he calls out and asks Noah to come help. It's Noah's third day on the job with Safety Sam Security Services and he isn't supposed to handle animal control matters, but he feels bad for Noah and agrees to try to help. He walks upstairs, with Omar and Amina following close behind. The lights aren't on, so Noah pulls out his extra heavy-duty flashlight that is assigned to all security guards. Standard operating procedures stipulate that it must be attached to his belt by a cord, so that it doesn't get lost or drop on his foot and cause injury, but he couldn't find the belt attachment that day. He gets to the top of the stairs and turns the flashlight on, only to find a squirrel less than 6 inches away from face. He screams and drops his flashlight right on Omar. It hits Omar's nose, which makes a cracking sound and immediately starts bleeding. While Noah stares in shock, the squirrel runs down the stairs and under the living room couch. Omar is bleeding all over his brand-new carpets and shaking from the sight of the squirrel, so Amina and Noah run downstairs to catch the squirrel. Noah suggests that they should be quiet and lure it out from under the couch with peanut butter, but Amina convinces Noah they should scare it out, so they go up close to the couch and yell. The squirrel runs out but runs straight into the fireplace, where it catches on fire. It then jumps out of the fire straight onto Amina's legs, scratching her shins and scorching her legs. She screams again and the squirrel jumps out the open living room window, straight into their neighbour Charlotte's garage, where she had been storing fireworks for an upcoming family reunion. The sparks from the squirrel's fur set off the fireworks and soon the garage is on fire. Within an hour, Charlotte's garage has burnt down, and Omar is admitted to hospital with a broken nose and severe shock. In addition to having a fear of animals, Omar also has a fear of doctors so refuses to let them set the nose back in place, leaving him with a crooked nose. Omar and Amina are also left with a $2,000 bill for replacing their blood-stained and burnt carpets. In addition, after Charlotte complained about the damage to her garage, Amina spent $10,000 to rebuild it. Questions: a. What kind of claim could Omar bring and against whom? b. What would Omar need to prove to succeed in his claim, what legal issues would be raised at trial, and what would the likely outcome be? c. What kind of remedies could Omar claim? d. What kind of claim could Amina bring and who would she bring it against? e. What legal issues would be raised at trial and what would the likely outcome be? f.
