There are several amendments that dictate how law enforcement does its duties. As acting governmental agents, law enforcement officers primarily deal with the fourth and fifth amendments. The fourth amendment protects the citizen from illegal search and seizure. Bohm & Haley (2021) explain, "Of all the due process guarantees in the Bill of Rights, those in the Fourth Amendment are the ones likely to require the most interpretation by the Supreme Court in the future" (p. 120). Search warrants, arrests, and roadside probable cause searches are all included in the fourth amendment. Government authorities are trained on proper search techniques and criminal procedures, in order to protect the fourth amendment; however, in experience and complacency leads to unintentional violations of the fourth amendment. The eight amendment is also a large factor in law enforcement and in judicial process. The eight amendment is largely associated with individuals who are incarcerated in a pre-trial setting or after sentencing has occurred.
