Overview

• For the Case Analysis, you will analyze both sides of a business law casethe plaintiff's and the defendant'susing concepts from the textbook.
• Based on your analysis, you will then reach a conclusion about which party should "win" the case, providing support for your decision.

Assignment Prompt

• Read the "Real Law Case 12-2: Exculpatory Clauses" (on p. 146 of the textbook). Then, find and apply relevant concepts from the textbook to analyze both sides of the case.
• Your paper should consist of three parts: an analysis of the plaintiff's side of the case, an analysis of the defendant's side of the case, and a conclusion.

OrganizationThe content of your paper should be organized as follows:

1. The Plaintiff's Side of the Case:

• Select at least three concepts from the textbook that are relevant to the plaintiff's side of the case.
• Apply the concepts using the following three-step process:

1. 1. 1. Identify the concept.
      2. Define the concept by quoting the definition from the textbook (and then cite it with an in-text citation that includes the page number, or section number).
      3. Apply the concept to the facts presented in the case by explaining how you see the concept illustrated in the case. Apply the concepts with as much detail and support as you can.

• Your analysis of the plaintiff's side of the case should be a minimum of one full page. If necessary, apply additional concepts from the textbook to reach the minimum length.
• The Defendant's Side of the Case:
  • Select at least three concepts from the textbook that are relevant to the defendant's side of the case.
  • Apply the concepts using the following three-step process:
    • Identify the concept.
    • Define the concept by quoting the definition from the textbook (and then cite it with an in-text citation that includes the page number, or section number).
    • Apply the concept to the facts presented in the case by explaining how you see the concept illustrated in the case. Apply the concepts with as much detail and support as you can.
  • Your analysis of the defendant's side of the case should be a minimum of one full page. If necessary, apply additional concepts from the textbook to reach the minimum length.
• Conclusion:
• In this section, you will state your conclusion. Based on your analysis, should the plaintiff or the defendant win the case? You must ultimately choose one side (even if it is difficult to do so!).
• Provide support for your conclusion.
• This section of the paper should be approximately one full page. However, it may be less IF the length of one of the preceding sections exceeds one page.
