Question:
Partner Lincoln has asked me to work on a case involving her new client, Joe Cooper. This case involves two men, Johnny Walters and Joe Cooper. Walters and Cooper were leaving a bar after some drinking and got into an argument. Walter was carrying a briefcase and as the argument got heated, Walter swung the briefcase at Cooper, causing Cooper to step back to avoid the briefcase. In stepping back, Cooper tripped over a low fence on the premises, injuring himself.
Cooper has contacted Partner Lincoln to represent him. Partner Lincoln wants me to research Cooper's options in filing an intentional tort action in Maryland against Walters. She has told me that I should find out the following:
1) What are at least four intentional tort actions that could be filed?
2) What specific elements that must be supported to be successful in these types of claims?
