QUESTION 2 Manukan worked as an accountant in one of the public hospitals- Recently, he was arrested and charged for disobeying a direction of the law, with intent to cause injury to any person under Section 166 of Penal Code. Luckily, he was released by the police after being investigated. He felt relieved and decided to take leave for few days. On Monday, he went to work as usual only to found out that he was given the notice to appear in a disciplinary proceeding forthe same charge he was anested for before. The hearing was scheduled to be held on the following day. Shocked and puzzled, he requested the management to postpone the proceeding as he was on leave when the letter was served. The management refused to postpone saying that they were not aware of that and blaming him for not informing the management about his leave. Disappointed, he requested the postponement of the proceeding to engage a counsel to assist him in the proceeding. Nevertheless, his request was objected to by Mantanani, one of the Disciplinary Board members. Mantanani, too was the person who reported to the management about Manukan's arrest. In the hearing, Manukan tried to use all evidence that he had to defend himself. However, the panels unanimously agreed that he is guilty and dismissed him from the service. Manukan was so upset about the decision as he believed that he was not given a fair chance to defend himself. He immediately came to you and asked for your advice. Advise Manukan. (20 marks)
