V1 1. On Saturday Sally decides she needs to make some money-quickly! She notices that the little Volkswagen car that her neighbor, Joe, owns is dirty. Sally goes to Joe and offers to wash Joe's car for $25. Joe says ok, but he's got to drive to Joplin today-could Sally wash it tomorrow, instead? Sally says that's fine, so Joe gives Sally $25 and Sally promises to wash Joe's car tomorrow (Sunday) afternoon. Sunday afternoon Sally goes over to Joe's to wash his car, but Joe tells her that, since today is the birthday of his son, Joey, Joe wants Sally to wash Joey's little Volkswagen car, instead. Because Joey is Sally's exboyfriend, she refuses to wash Joey's car and she goes home mad. Under these circumstances Sally is liable for breach of contract. 2. In order to satisfy the Statute of Frauds, it is not a requirement that both parties to the contract sign the writing that gives evidence of the oral contract. 3. Henry Homeowner and Peter Painter make a contract that Peter will paint Henry's house, for $1,000. The contract specifies that Peter will paint Henry's house next month, and that Peter will use Sherwin Williams paint in doing so. However Peter decides to use Dutch Boy paint, instead, and paints the house with that brand. Under these circumstances Sherwin Williams cannot successfully sue Peter Painter. 4. James knows that Ashley wants to buy a house, and that she's ready to put in a bid on the house next door (which house is for sale). However, James decides he'd like to move, and wants to sell her his house. He says to Ashley, "I'll sell you my house for only $100,000." Ashley says to Jim "ok", and tells the people next door that she's no longer interested in their house-so they sell their house to someone else. The next day James changes his mind, and decides he doesn't want to move, after all. Under these circumstances James is not legally required to sell Ashley his house. 5. Alice agrees to pay $50 to Ace Widget Shop, but Ace Widget Shop assigns its right to receive the payment to Bank Y. If Alice is not notified of the assignment, then she can discharge her obligation by paying Ace Widget Shop. 6. Emmit Employee enters into an oral contract with Ellen Employer that he will work for her at a salary of $1,000 per month. This contract is enforceable. 7. Because a third party beneficiary does not always have the right to enforce the contract, it is important to distinguish between a done and a creditor beneficiary. 8. If an oral contract is made which falls within the Statute of Frauds, that contract is void. 9. An assignment is not "legal" until notice is given to the obligor. 10. Mike's son, Jim, owes $50 to Ben Bartender, and the debt is overdue. Mike says to Ben, "Don't worry about it, I will pay Jim's debt." If Mike's promise is oral, it is unenforceable because of the Statue of Frauds
