This evening, he had a personal event and he was in a hurry. He felt like the air conditioner was not working in the stocking room but he decided to leave it to the next day as he wanted to be on time for his event. During night, the whole stocking area had exploded due to the over heat. Jim's house, who is just nextdoor where the explosion has happened, has been completely destroyed. The value of the house is USD 200,000. a) Can Jim sue Tom for his loss (the destroyed house) based on the tort of negligence? Please answer this question by assessing all the conditions of tort of negligence in the case. (15 marks) b) What if it turned out that the explosion had nothing to do with the air condition or any other stocking conditions. Can Jim still sue Tom based on tort law to get reparation if no fault can be proven on the side of Tom? Please explain your answer. (10 marks)
