please help me find the 17 things wrong with this case
PERFORMANCE APPRAISAL CASE You have been hired as the new Human Resource Manager for WHO CARES, Inc. The plant manager passes along a notice, just received from the EEOC, notifying you charge a charge of discrimination in terminating Ms. Suzy Jones for poor performance based on her periodic performance appraisal. Your investigation reveals the following information about the company's appraisal system: The appraisal form was copied from another company. You can find no guidelines of instruction. The operations manager explains to you in your investigation that there was no training since all the personnel supervisory positions have been doing it for atleast 10 and therefore have all the experience that they need. You discover that all the supervisors meet to discuss ratings once a year before assigning a final rating. The final rating is based on each supervisor's judgment and may weigh the factors differently depending upon the circumstances. There is a place for higher management to sign indicating their review. You determine that Ms. Jones was a plant trades person (mechanical; labor type work) and the supervisor told you that critical job factors are job knowledge, teamwork, safety, attitude, aggressiveness, and attendance. Personnel records reveal that Ms. Jones has had perfect attendance and was only tardy one time during the past 12 months. Interviews with workers and other supervisors shows that she often did extra work without being told, even helped others without suggestion, cooperated with all. She followed all safety rules and encouraged others to do the same. Her former supervisor admits she was fired for poor housekeeping practices. Ms. Jones appraisal is shown below: Comments: Solid employee but she is a lousy housekeeper for a woman. Employee acknowledgement of receipt: (no signature) Your comments and suggestions as to legality of the appraisal, its accuracy, etc., chances of winning the lawsuit (and explain why) and how you would improve it the form and the appraisal system
