In determining to whom to award a promotion, an employer was torn between awarding it to a single female employee who had no children and a male employee, who was the sole breadwinner with a family. Both employees were equally qualified for the promotion. The employer decided to award the male employee the promotion, reasoning that the male employee, because of his family responsibilities, most needed the extra money that the promotion would afford. The employer then admitted to thetfemale employee that he gave it to the male employee because the male employee was a family man and needed the money. If the female employee sues for gender discrimination, what type of evidence will she offer to prove discrimination? Will she win?
